57 people dead, including women, lawyers, and journalists just because a group of people wanted to file a certificate of candidacy. Elections hasn't started yet. Naturally, the international community is appalled. It is reminiscent of Cambodia and the Khmer Rouge, only this time it is not a matter of clashing ideologies but unmitigated greed—for power, money, and more power and money. In the Philippines, running for public office is an investment. A candidate has to recoup his capital. How does he do it then? Corruption. How does he profit? More corruption. And when he or his family can no longer run for public office (generally allowed 3 terms of 3 years each), he so casually resorts to murder and violence. These are the people we elect??DON'T VOTE . IT IS A COMPLETE WASTE OF TIME AND EFFORT. EVERYBODY HAS AN INTEREST TO PROTECT AND POLITICAL DEBTS TO REPAY. So what should Mang Pandoy do? Well, if he has a relative abroad, simply migrate and get away from this political hellhole they call the Pearl of the Orient Seas. If he cannot go abroad or loves this country , stay , just go about your business, try to make a difference-even a small one-in other people's lives, and more importantly, leave the political monkeys to themselves. Perhaps, the only sign of political maturity we can hope for is complete indifference. Unlike Gandhi's passive resistance, there should be active indifference. Filipinos are so politicized, they forget what they are running for or voting for. SO GO OUT AND CHOKE.

Two Filipino success stories filled the news in the last couple of weeks.

There of course was the sensational humiliation handed down by boxer Manny Pacquiao on Miguel Cotto, in the process winning an unprecedented 7 titles in different weight categories. President Macapagal Arroyo immediately rewarded this with the highest civilian honor that the Philippine government can give. It did not hurt that Pacquiao won millions in prize money and more in cable sales, and a crack at another boxer for a whooping 50 Million US Dollars. Nor the fact that he is again running for Congress, reportedly in another City because he lost heavily in General Santos when he last run for Congress. Pacquiao was being heralded as the best boxer of all time, besting allegedly legends like Sugar Ray Leonard and the Greatest himself, Muhammad Ali. If Pacquiao were not alive and kicking, he might have replaced Rizal as the National Hero.

The other success story was that of Efren Penaflorida, a Filipino who brought education to hundreds of poor children in the slums using a makeshift wooden cart, borrowed education materials, and a hardy group of volunteers. He was not famous. He did not have his own TV show. He did not have money. He did not even have to do what he does. He could as easily have chosen a path that most young men take, probably work in an office and go home to a family. Yet, he chose to make a difference in the lives of others. For being CNN Hero of the Year he got 100,000 usd, small change when compared to Pacquiao's Millions. But who did the Filipino public adore more, the internationally famous boxer with all his riches and glamor riding in his luxury cars or the humble, unknown educator in the slums pushing his makeshift wooden cart and like the pied piper playing the music of hope for hundreds of children who can afford only hope in their lives. Why must it take a foreigner to recognize this hero in our midst ? Why must the awards and titles go to someone who breaks another man's face for a living instead of to somebody who has dedicated his life to make a difference?? Am I missing something here…huh??

Lately, a survey of international businessmen again voted the Philippines as one of the more corrupt and graft-ridden countries in the world. I have often wondered why that is so. Historically, they say that the padrino system of Philippine politics has something to do with it. In fact, when the Americans started their occupation of the Philippines at the turn of the last century, one of the rights not extended to the colonial Filipino was the right to be tried by a jury of his peers. The other right was the right to bear arms. One could understand the latter because of the exigencies of war. But the other was never explained officially, although rumors have it that the Americans thought the early Filipinos were so tightly knit as families that it was impossible to get a fair trial anywhere in the Philippines. The argument was any jury selection would invariably include a relative of either the complainant or the accused who would then be easily swayed if not bribed to look the other way. Instead, they entrusted the judicial tasks to individual judges. Is the judiciary better off now because of this historical and legal experiment??? Did the experiment bestow too much power on one person to decide the fate of a case on his own , and thus possibly breed the tentacles of corruption that we know now. Of course, corruption is not perceived only in the judiciary but in all levels of government. But parallels can be made with the creation of the first Philippine Commission by the Americans instead of a popularly elected Congress in 1901 because they thought most Filipinos were not yet ready to decide for themselves who should rule the country. Unwittingly, this created the first cronies of Philippine politics since it concentrated power on a group of influential and very regionalistic politicians. This literally put graft and corruption Philippine style well on its way.

I think it was the late Ramon Magsaysay who said that those who have less in life should have more in law. A clever play on words which has been fodder for social justice decisions of the Philippine Supreme Court and pro people legislations of the Philippine Congress. Ironically, however, it is this writer's belief that social justice or at least the Filipino's perception of it, is actually the root of corruption in government, especially in the judiciary and quasi-judicial agencies. Take, for example, our labor tribunals, by the Constitution and by existing legislation, all things considered equal they are mandated to rule in favor of the employee because of social justice. There, immediately, the playing field is not leveled and this reality is not lost to the businessman who sees corruption as the only pragmatic recourse to keep the legal footing in equilibrium. Wouldn't it be a better policy to judge each case on the pure merits without invoking social justice, lest we do a social injustice in the long run?

INTERCOUNTRY ADOPTION

One of the significant changes in immigration law was the incorporation of the Hague Convention on Protection of Children and Co-operation in Respect of Inter-country Adoption or the Hague Adoption Convention into the rules for adopting children from a foreign Convention country. The Hague Adoption Covention, which took effect on April 1, 2008, introduced a new procedure for adopted children emigrating to the United States from a country who is a signatory to the Convention. The United States and Philippines are among the 75 countries where Hague Adoption Convention is in force. The new rules do not apply to children coming from countries who are not signatories to the Hague Adoption Convention such as Russian, South Korea, Ethiopia, or when the adoption was finalized before April 1, 2008.

The Hague Convention Adoption governs the case if the prospective adoptive parents are considered habitual residents of the United States and the child is a habitual resident of another Convention Country like the Philippines, and the child will be immigrating to the United States To confirm if the Hague Adoption Convention applies to the case, the attorney must look into the “habitual residency” of the parties involved in the adoption. It is not enough to rely on the citizenship of the prospective adoptive parents, or that of the child, to understand whether the case is a Hague case. Under the regulations, a United States citizen with a domicile in the United States, even if he/she temporarily lives abroad, is considered a habitual resident. If the United States Citizen is not domiciled in the United States, he/she will have to establish that he/she will have a domicile in the United States on or before the child's admission in the United States as a lawful permanent resident (LPR); or b) he/she will have a domicile in the United States after adopting the child abroad and before the child's 18th birthday, so that the child may obtain naturalization as a USC. Only then will the United States Citizen be considered a habitual resident of the United States. The child is a habitual resident of his or her country of citizenship.

What if the prospective adopted parents are United States citizen but are domiciled in the Philippines? The Hague Adoption Convention will not apply. They can adopt the child in the Philippines and establish two years physical and legal custody. If the prospective adoptive parents later decide to come back to the United States, they can file an I-130 petition on behalf of the adopted child.

What happens if the child is a citizen of a foreign Convention country but is residing in the United States? On September 29, 2008, US Citizenship and Immigration Services (USCIS) provided guidance on cases like this. USCIS explained that the regulations could be interpreted to permit a finding that a child is no longer a habitual resident of the country of citizenship, and is instead a habitual resident of the United States. In such a case, it will be considered a Non-Hague case and the child may be adopted locally in the United States. Before the case can be considered a Non-Hague case, certain requirements need to be met.

What happens if the adoption was finalized before the Hague Adoption Convention took effect or prior to April 1, 2008? The adoptive parents may pursue the case as an I-130 case and follow the old immigration procedure for petitioning an adopted child. Under such procedure, the adoptive parents must establish two years legal and physical custody before filing the I-130 petition. If the child is an orphan, the adoptive parents may pursue the case as an I-600 case. Only a United States Citizen is eligible to file an orphan petition, provided that the petition is filed prior to the child's 16th birthday. A child is an orphan: 1) due to the death or disappearance of, abandonment or desertion of, or separation or loss from both parents; or 2) when the sole or surviving parent is incapable of providing proper care for the child and has irrevocably released parental rights to the child in writing for emigration and adoption. If both biological parents are alive but have abandoned the child to an orphanage or other authorized institution of the child's home country, the child may be considered to be an orphan.

What happens if the case was started before April 1, 2008, and has not been completed when the Hague Adoption Convention took effect? The case may be considered a transition case depending on the facts of the case. The determination whether the case is a transition case can be complicated and it is best to get the advice of an immigration attorney. If the case has not been grandfathered, the prospective adoptive parents have to start the process all over again.

What happens if the prospective adoptive parents obtained custody for emigration purposes and adoption after April 1, 2008? The custody decree must be voided. Otherwise, the I-800 will not be approved. What if the prospective adoptive parents or their relatives obtain temporary custody of the child or provided foster care before April 1, 2008, not for the purpose of adoption. Then, after April 1, 2008, the prospective adoptive parents became US citizens and decided to adopt the child. Will the I-800 be approved? Unfortunately, there is no guidance on this issue. This is only one of the many issues where no guidance has yet been issued by either USCIS or the Department of State (DOS). Inter-country adoption is a complex process and the Hague Adoption Convention is relatively new. We are hoping that USCIS and DOS make liberal interpretation of the regulations so that more children would benefit from the Hague Adoption Convention.

Perez, svplaw@aol.com | SAN DIEGO, 10/30/09 — I've been receiving a lot of inquiries whether legal permanent residents or greencard holders can sponsor their spouses to live or stay in the United States. Most of these inquiries involve a foreign national who is in the US on a tourist visa and had met a legal permanent resident who offered him or her marriage. They want to know if the foreign national can stay in the US if they get married. While a legal permanent resident can sponsor or petition his or her foreign national spouse, this does not give the foreign national spouse the status of an immediate relative. Therefore, the foreign spouse cannot stay in the US while waiting for the legal permanent resident spouse to become a US citizen.

Only US citizens have means of bringing their foreign husbands or wives to the US to live. The US citizen can “sponsor” his or her spouse's immigrant visa for entry to the United States. First, an immigrant petition has to be filed with USCIS. After USCIS, the National Visa Center and the US Embassy complete all the necessary administrative processing the foreign spouse will be granted an immigrant visa. The foreign spouse will receive an IR1 or a CR1 visa. An IR-1 (IR stands for “Immediate Relative”) visa allows your spouse to immigrate to the US A CR1 Visa (CR stands for “Conditional Residency”) will be to the foreign national if the marriage is less than 2 years old. It is conditional for two years.

A K-3 visa is relatively new and the fastest way of getting your spouse to live in the US It is a non-immigrant and is granted normally within a few months. You should use the K3 visa to start the process outside of the US, then travel to the US to complete the immigration process. In this case, the application must be made in the country where the marriage took place. If your marriage took place in the US, your spouse must apply for a K3 visa through the US Embassy in the country of his/her residence. After the visa has been issued, the spouse can travel to the US.

To obtain a visa for a foreign spouse, the following requirements must be met: 1) the marriage must be legal; 2) the US citizen must be a resident of the US, and 3) the US citizen must be at least 18 years old. If the US citizen is currently living outside the US, he or she must submit the immigrant petition to either the local office of USCIS or directly to the US Embassy where the foreign spouse resides. If the spouses are already in the US, the immigrant petition and adjustment of status can be submitted simultaneously with USCIS. Spouses of US citizens, and the spouse's children, can come to the United States on nonimmigrant visas and wait in the United States to complete the process.

An earlier  blog discussed the need for a definitive list of lawyers and attorneys in the Philippines.  That was just a week ago and we contented ourselves with a list of the recent members of the Philippine Bar. But the wonders of technology have allowed us to merge the Roll of Attorneys of the Philippine Supreme Court up to 2003, with the lists of attorneys from the same site from 2004 to 2009, arranged alphabetically for easy searching using Microsoft Excel. The masterlist is by no means an infallibly compete list as it includes lawyers and attorneys who may probably be deceased already or who may not be actively practicing law. Readers may click on the following link for information purposes only, but are encouraged to seek official certification from the Supreme Court of the Philippines or the Integrated Bar of the Philippines if they doubt the credentials of a particular attorney. We are excited about this development, but we have future and rather ambitious plans of coming out with a list of lawyers and attorneys in the Philippines of good standing with both the Philippine Supreme Court and the Integrated Bar of the Philippines, less those who have passed on to final judgment and definitely weeding out those who did not even pass the Philippine bar but who are passing themselves off as lawyers and attorneys.

MASTERLIST OF PHILIPPINE LAWYERS

There was one judge in Quezon City  who used to require lawyers and attorneys appearing before him to show their Integrated Bar of the Philippines (IBP) identification Cards. This, I thought , was a very good practice because too often I have wondered if all the lawyers and attorneys appearing in our courts and quasi-judicial agencies are actually licensed to practice law, or God forbd, are really the lawyer persons they are claiming to be. As far as this writer knows, there is no definitive list of lawyers and attorneys in the Philippines, which would include all members of the bar who are actually still living. True, you have the Roll of Attorneys of the Philippine Supreme Court , which I noted of late has been requiring mug shots ( so to speak) of incoming members of the bar. This was not the practice when this writer passed the Bar. There was a photographer who,  we assumed was authorized by the Supreme Court, to take several pictures of the signatories of the Roll of Attorneys. After the photo op, the guy would approach you for money to buy the photo. So I never thought that  the photos taken were official. At least now, they ask the incoming members of the bar to pose with their Roll of Attorneys Number for all posterity  (like they do for the accused in the movies) . Poor new members of the bar. Let us all hope that they were read their Miranda rights.
Going back to the official Supreme Court Roll of Attorneys, it includes the date of birth, place of birth,  date of admission to the Bar, and Roll Number of a lawyer. However, except for those who were born a century ago, how sure are we  that Attorney Pandoy who is representing us in a case  is really Attorney Pandoy who is listed in the roll of attorneys. For all we know, the guy is already dead. The secondary list of all lawyers and attorneys in the Philippines is that of  the Integrated Bar of the Philippines (IBP), which after all is regulated by the Philippine Supreme Court. But at best, the IBP list merely shows those who have dutifully paid their IBP membership dues. But how about those who have gone abroad or those who have passed on to the final judgment??What if some unscrupulous individuals saw the opportunity to use the name of Attorney Pandoy who has gone on to the next life and continued to pay his IBP membership dues, or worse, was able to obtain a Lifetime card after paying the required fee.  It is not very difficult to pass one's self off as a lawyer. You see it on television everyday.In fact, some actors are better at it than some lawyers we know.

So the next time you are left wondering if the lawyer you hired is really a licensed lawyer or pretending to be one, ask him or her  for some proof or, consult the lists mentioned above. If you are still not satisfied, log on to this blog when you can because we will try to come up with an updated list of sorts.Nothing official though. Just some contribution in our own small way of educating and informing the public at large, and yes lest we be charged of being blase about it, improving our web site traffic as well.

We will approach the updating of the list of lawyers and attorneys of the Philippines , initially with the 2009 updated list of lawyers who passed the recent bar examinations. We will work from the bottom up using the official roll of attorneys of the Supreme Court of the Philippines.

I do not know if this blog is the proper place or the opportunity to say something about the holiness of marriage and whether annulment or divorce is antithetical to this concept. After all, a lawyer's blog is expected to promote a service for a fee. But then again, lawyers believe it or not are also human, and we do have spiritual lives to live. Since part of our practice is Philippine Family Law, which includes annulments or declarations of nullity of marriage, to this writer and the lawyers of the firm, our approach to a broken marriage is almost always “clinical” in nature. Too often , we look at a case as a collection of facts oblivious to the reality that there is behind those facts people and children in pain. A family in the throes of failure, and lives forever hurt by indifference and self-centeredness. It has always been a wonder how two people who were so in love could end up the worst of enemies. (they say there is a very thin line between love and hate) . Marriage , we are taught, is a sacred institution ( a legal one too). It has been used in scriptures as the model by which God has fashioned his church as a covenant with his people. So, while annulment of a marriage is allowed by law, is it, nonetheless, un-Christian ??

In another blog, we already mentioned the fact that the Philippines and Malta are the only two countries which do not allow for absolute divorce. In one account of the proceedings of the Committee which came up with the Family Code of the Philippines, it would seem that annulment in the Philippines was a compromise between the Catholic church in the Philippines and the Committee members, the intent being that the ground of psychological incapacity for the nullity of a marriage should be interpreted restrictively and should follow the lead of Canon Law. Early Philippine cases have reflected this struggle. Recent decisions have tested this concept though. Be that as it may, annulment then as a legal concept is NOT anathema to the sacredness of the institution of marriage since the Church allows the same based on certain grounds. . But the church taking into consideration that a marriage is made up of fallible human beings has allowed for a mechanism for the nullification of that marriage to pave the way for the remarriage of the parties in the hope that given a second chance the parties would be able to find happiness ever after. Perhaps then, this should be the way we should look at what we do. While there is of course a deep-seated constitutional separation in the concept of annulment between the Church and the State, and an annulment in either institution is not binding on the other, lawyers and the courts should be the instrumentalities to bring this about. In doing so, it is hoped that we promote peace, the good of all, and with a tinge of irony rest in the thought that it is the man-made way of precisely upholding the sacredness of marriage both as a social and legal institution. Without giving human beings some allowance for their weaknesses and foibles, marriage would be nothing but a necessary evil of sorts, recognized more in its violation than its observance.

After spending almost four months in the United States , I planed to Manila while the final rites on the late President Corazon Aquino were being held at the Manila Cathedral. She was the guest speaker at my graduation from the Ateneo School of Law way back in 1988, and I could still recall the tension that reigned in the country a year or so after the EDSA Revolution, which has since experienced several revisions (EDSA 2 and EDSA 3). The outpouring this time brought memories of Ninoy Aquino's final rites and looking at the throng of people who braved rain and hunger, it was a political revival of sorts. Again, the oft repeated phrase “The Filipino is worth dying for” rang true. A couple of days of jet lag (just like the couple of years after the 1986 EDSA Revolution) again proved me wrong. While the debate in the United States was on so called “death panels” allegedly created by a proposed health and welfare legislation in the US Congress, Filipino newspapers have completely gotten over the solemnity and grief of the Cory Aquino funeral and was now riddled with a 20,000 dollar dinner at Le Cirque in New York shared by President Arroyo and members of her entourage. How trivial can we be??is there no better issue to fight about than a dinner in New York??
